DMCA Policy

Modyrn Pulse, operated by BSM Enterpryzes LLC, respects the intellectual property rights of others and expects users of our platform to do the same. We comply with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512, and will respond promptly to valid copyright infringement notices.
1. Reporting Copyright Infringement
If you believe that content available on Modyrn Pulse infringes your copyright, you may submit a DMCA takedown notice to our designated copyright agent. To be valid under the DMCA, your notice must include all of the following:
Required Elements of a Valid DMCA Notice
- Identification of the copyrighted work — A description of the copyrighted work you claim has been infringed, or if multiple works are covered by a single notice, a representative list of such works
- Identification of the infringing material — A description of the material you claim is infringing and that you want removed, with enough detail for us to locate it on the platform (include the URL)
- Your contact information — Your name, address, telephone number, and email address
- Good faith statement — A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law
- Accuracy statement — A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act on the copyright owner's behalf
- Physical or electronic signature — A physical or electronic signature of the copyright owner or authorized representative

3. Our Response to Valid Notices
Upon receipt of a valid DMCA takedown notice, we will:
- Remove or disable access to the allegedly infringing content promptly
- Notify the user who posted the content that it has been removed
- Provide the user with a copy of the takedown notice (with your personal contact information redacted where appropriate)
- Inform the user of their right to submit a counter-notice
4. Counter-Notification
If you believe your content was removed as a result of a mistaken or misidentified DMCA notice, you may submit a counter-notification. To be valid, your counter-notice must include:
- Your physical or electronic signature
- Identification of the material that was removed and the location where it appeared before removal
- A statement under penalty of perjury that you have a good faith belief that the material was removed as a result of mistake or misidentification
- Your name, address, and telephone number
- A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or the District of Colorado if you are outside the United States)
- A statement that you will accept service of process from the person who submitted the original takedown notice
Send counter-notifications to dmca@modyrnpulse.com with the subject line "DMCA Counter-Notification."
Upon receipt of a valid counter-notification, we will restore the removed content within 10-14 business days unless the copyright claimant files a court action seeking to restrain the alleged infringement.
5. Repeat Infringer Policy
In accordance with the DMCA and other applicable law, Modyrn Pulse has adopted a policy of terminating accounts of users who are repeat copyright infringers. We may also limit access to the platform for users who infringe the intellectual property rights of others, whether or not there is any repeat infringement.
6. Misrepresentation Warning
Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake, may be subject to liability for damages. Do not submit a DMCA notice if you are not certain the material infringes your copyright.
7. Register Your DMCA Agent
BSM Enterpryzes LLC registers its designated DMCA agent with the United States Copyright Office as required by 17 U.S.C. § 512(c)(2). Registration is maintained at copyright.gov/dmca-directory.
