1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and BSM Enterpryzes LLC ("Company," "we," "us," or "our") governing your access to and use of Modyrn Pulse at modyrnpulse.com ("Platform"). By creating an account or using the Platform, you confirm that you are at least 18 years of age and agree to be bound by these Terms.

2. Eligibility

You must be at least 18 years of age to use Modyrn Pulse. By creating an account, you represent and warrant that:

• You are at least 18 years old
• You have the legal capacity to enter into a binding agreement
• You will provide accurate and truthful information when creating your account
• You are a real human being and not an automated bot or AI system

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately at benterpryzes2084@gmail.com if you suspect unauthorized access to your account.

We reserve the right to terminate accounts that violate these Terms, impersonate others, or engage in fraudulent activity.

4. Subscription and Payments

Free Plan: Access to daily content, polls, inspiration cards, news ticker, and the ability to upload videos is free.

Pulse Pro — $12.99/month: Subscribing to Pulse Pro grants you access to watch creator videos, publish your uploaded videos, and receive a Verified Human badge. Pulse Pro subscriptions are billed monthly through Square.

Cancellation: You may cancel your Pulse Pro subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. No refunds are issued for partial billing periods.

Price changes: We reserve the right to change subscription pricing with 30 days notice to your registered email address.

5. Creator Content

Modyrn Pulse is a human-first platform. All creators must be verified human beings. By uploading content you agree that:

• You are the original creator of the content or have rights to upload it
• The content does not violate any third-party intellectual property rights
• The content complies with our Creator Guidelines
• You are not using AI-generated video, audio, or imagery without disclosure
• You are not using face filters, deepfakes, or other digital alterations that misrepresent your appearance
• The content does not contain illegal material or content harmful to minors

You retain ownership of your content. By uploading, you grant BSM Enterpryzes LLC a non-exclusive, royalty-free license to host, display, and distribute your content to Pulse Pro subscribers on the Platform.

6. Prohibited Conduct

You agree not to:

• Upload AI-generated content without disclosure
• Impersonate any person or entity
• Upload content that is illegal, obscene, defamatory, or harassing
• Attempt to gain unauthorized access to the Platform or other users' accounts
• Use automated bots, scrapers, or scripts to access the Platform
• Circumvent or attempt to circumvent any content restrictions or paywalls
• Upload content that violates any applicable laws
• Share your Pulse Pro account credentials with others

7. Creator Payouts

BSM Enterpryzes LLC may offer creator revenue sharing programs at its discretion. Any such programs, including payout rates, eligibility requirements, and payment schedules, will be communicated separately. We reserve the right to modify or discontinue creator payout programs with reasonable notice.

8. Intellectual Property

The Modyrn Pulse name, logo, platform design, and original content created by BSM Enterpryzes LLC are the intellectual property of BSM Enterpryzes LLC. You may not use, copy, or reproduce any of our intellectual property without written permission.

Creator-uploaded content remains the intellectual property of the respective creators.

9. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or any conduct we determine to be harmful to the Platform or its users. Upon termination, your right to access the Platform ceases immediately.

10. Disclaimer of Warranties

Modyrn Pulse is provided "as is" without warranties of any kind, express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses. BSM Enterpryzes LLC disclaims all warranties to the fullest extent permitted by law.

11. Limitation of Liability

To the fullest extent permitted by applicable law, BSM Enterpryzes LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform. Our total liability to you shall not exceed the amount you paid to us in the 12 months preceding the claim.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Colorado.

13. Changes to Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last Updated" date and notify registered users by email. Your continued use of the Platform after changes are posted constitutes your acceptance of the updated Terms.
